Exceptions exist where the parties expressly agree that they may recover their legal fees from one another or where statutes or equity provide for it.

Some examples of construction cases in which one may seek the recovery of fees include those based on (1) interpretation or breach of the construction or design contract, (2) deceptive trade practices, (3) mechanic’s lien foreclosures/removals, and (4) some warranties.
